The following are the Terms and Conditions, read together with the Privacy Policy, that govern your purchase and use of the products and services (the "Products") from Safwan’ s website , and constitute a legally binding agreement, between you ("the Customer", the "User", or "You") and eSafwan.com, a fully licensed Company.
By visiting, viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted to www.eSafwan.com, you are deemed to have agreed to all the following Terms and Conditions of Sale/Service. So, before you use this Website, please read these Terms carefully as you agree to be bound by them. If you do not accept these Terms and Conditions, please do not use this Website.
1. Creating an Account
1.1 To use certain features of the Website (e.g., ordering Products, posting rating/reviews, receiving Safwan newsletters), you must set up an account with eSafwan.com (“Safwan Account”) and provide certain information about yourself as prompted by the Customer Information form, including, your name, gender, email address, account password, mobile phone number and billing/shipping address. All of your registration information is protected by our Privacy Policy.
1.2 You represent and warrant that the information you submit during registration is truthful and accurate and that you will maintain the accuracy of such information.
1.3 Your Safwan Account username and password are personal to you. You may not transfer your account and you will be responsible for the activities associated with your Safwan Account.
1.4 Safwan.com will not be liable for any loss or damages as a result of your failure to maintain the confidentiality of your account credentials. If you suspect any unauthorized use of your Safwan account, you shall immediately notify eSafwan.com.
1.5 It is your responsibility to keep your email address up-to-date on your account setup at eSafwan.com so that we can communicate with you electronically.
2. Privacy Policy
2.1 Your personally identifiable information will be used in accordance with our Privacy Policy. To understand our practices, as to how we collect, use and disclose your personally identifiable information, please refer our Privacy Policy, which also governs your visit to eSafwan.com.
2.2 We understand the privacy of all information you provide is of a primary importance. This is why we do everything possible to use it carefully and sensibly. This information is never shared with other companies or third party service providers.
3. Security Policy
All your transactions are 100% secure when you place an order online at eSafwan.com. Your personal information is encrypted by using protected with 256-bit Secure Sockets Layer (SSL) software. technology before being sent over the Internet, which ensures the privacy and high level of security of all your information.
4. Customer eligibility
Our Customers or Users must be over 18 years of age and registered with us. eSafwan.com is not intended for children under the age of 18. We will not knowingly collect information from Safwan visitors in this age group.
5. Price and Payment
5.1 All our product prices include all applicable statutory taxes.
5.2 We make every effort to make sure that the pricing and availability of Products on our Website is accurate and up to date. However, rarely, there may be an error on the pricing of a product or an error related to product availability. In such cases, we are not responsible for any typographical errors and we reserve the right to cancel the sale.
5.3 We reserve the right to correct any inaccuracies or omissions related to pricing and product availability/descriptions, even after you have submitted your order, and to change or update any other information at any time without prior notice.
5.4 Our standard delivery charges is a lamp sum amount of 1.5 KD on all orders.
5.5 Delivery times is within 2 working days time bracket
5.6 In case our customer service representatives are unable to reach the customer within 24 hours of placing the order; it will automatically be deemed as cancelled.
5.7 Upon receipt of full payment, the customer service representative will hand over the Products with the invoice and the delivery note.
5.8 It may be noted that we do not accept payments by Cheque, Gift Vouchers or Discount Coupons in place of Cash or Card when using Payment on Delivery option (Discount Coupons if applicable, should be applied prior to checkout).
5.9 Ordered Products cannot be withheld by the customer on credit. Payment for the Products ordered is to be made at delivery. It may be noted that the person taking delivery of the Products should be the Registered User who had ordered the Products or his/her authorized person, providing adequate proof of such authorization.
5.10 You can make the payment via any one of the following methods of payment: Credit/Debit Card, KNet Banking.
5.11 Credit/Debit Card and Net Banking Payments are processed via our online payment service partners.
5.12 To ensure that your Card is not being used without your consent, if you select K-net as your favored payment method we will direct you to the K-net payment gateway where you will be asked to enter your Card details (e.g. card number, expiration date, & pin code). Alternatively, if you chose Visa/MasterCard as your preferred payment method you will be directed to the MasterCard Internet Gateway Service website (MIGS), where you will be required to enter your Card details (e.g. card number, expiration date & pin code). We may validate your name, address, and other Personal Information provided by you during the order process against appropriate third party databases. By accepting the Terms, you consent to such checks being made. In performing these checks, Personal Information provided by you may be disclosed to a registered Credit Reference Agency (K-net or MIGS), which may keep a record of that information. You may note that this is done only to confirm your identity and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the applicable law.
5.13 Responsibility to verify the Customer and Customer’s Card Information and to rightfully authorize the transaction deducting payments from the card lies with the respective payment gateway and /or the issuer bank of the card being used. Safwan is not liable for any losses or damages occurring out of fraudulent transactions happening due to attacks or breaches on any payment gateway, attacks or breaches on issuer banks, or due to Customer’s Card details, PIN verification details, password verification details or any other details authorizing purchase on the payment gateway being acquired by persons of malicious intent or persons who may not be the rightful owners of the card.
5.14 Payment on Delivery option is not available for all Products and Products covered under the Pre-Order category, but is available for select Products as can be seen on the Website during your purchase of Products.

6.1 The information provided on the Website or through our services is intended for informational purposes only, and is not intended to diagnose, treat, cure or prevent any disease.

10. Terms of Sale
10.1 eSafwan.com may accept or decline any order placed by a Customer in its absolute discretion without liability to you, accordance with the laws of the state of Kuwait.
10.2 eSafwan.com reserves the right to discontinue any program or offer on its Website.
10.3 We reserve the right, without prior notice, to limit the order quantity of any Products available on eSafwan.com.
10.4 We acknowledge and you agree that you have fully and accurately disclosed your personal information and personal health information and consent to its use by the company and/or its affiliates. By making this purchase you hereby authorize Safwan and/or its affiliates to ship the order by Post/courier to your designated location.

10.7 "If you are the customer/parent/legal guardian/authorized person for the customer disclosed herein, you affirm that you are over the age of majority, and have full authority to sign for and provide the above representations to the company and/or its affiliates on the customer’s behalf."
11. Placing orders Policy
11.1 eSafwan.com, a fully licensed and regulated company, takes all precautions to strictly abide by the laws and regulations. By placing your order, you acknowledge and accept the following terms regarding the purchase of any medicines or items.
11.4 The items information provided in the eSafwan.com is for informative purposes only and this Website is not intended to provide diagnosis, treatment or medical advice. We are not liable for any adverse effects or harm to you as a result of your reliance on the information in the Website.
11.5 Safwan requires either the User or Customer to confirm he/she is completely aware of the indications, side effects, drug interactions, effects of missed dose or overdose of the items he/she orders from us. It is imperative to seek professional advice from your physician before purchasing or consuming any medicine from eSafwan.com.
12. Return and Refund Policy
At eSafwan.com, we do our best to ensure that you are completely satisfied with our products. And we are happy to issue a full refund based on the conditions listed below:
Full Refunds Possible If:
• you received a defective item;
• the ordered item(s) is lost or damaged during transit;
• The ordered item(s) is past its expiry date.
We also understand that various circumstances may arise leading you to want to return a product or products that are not defective, in these cases, we may allow the return of unopened, unused, salable products after deducting a 00% restocking charge; the policy of return/ exchange will be valid within 14 days of the date purchase, accordance with the Consumer Protection Law no.39/2014.
Please note: Mode of refund may vary depending on circumstances. If the mode of refund is by Credit/Debit Card or Net Banking, please allow 7 to 10 working days for the credit to appear in your account. While we regret any inconvenience caused by this time frame, it is the bank’s policy that delays the refund timing and we have no control over that. If the mode of refund is by e-wallet, credit should be available within 24 hours.

Neither the receipt of any funds by Safwan nor the reliance of any person on Safwan actions shall be deemed to constitute a waiver of any part of these Terms and Conditions. Only a specific, written waiver signed by an authorized representative of eSafwan.com shall have any legal effect whatsoever.
18. Submissions
